The Procedures for Approval of Extension and Change Plan for Utilization of Foreign Workers based on Government Regulation Number 34/2021

If the Plan for Utilization of Foreign Workers (RPTKA) owned by the employer is about to expire, the employer is obliged to extend the RPTKA, if he wishes to continue to employ the foreign worker concerned. Employers can also make changes to the RPTKA if the foreign worker data changes.

Can the RPTKA be extended and what are the requirements?

Yes. The ratification of the RPTKA can be extended, except for the RPTKA for temporary work, with the following requirements:

  1. The Employer of the Foreign Worker shall submit an application for an online extension of the Ratification of the RPTKA to the Minister or the appointed official.
  2. Application for extension of RPTKA Ratification shall be submitted no later than 30 (thirty) working days before the end of the period.
  3. Employers of foreign workers shall apply for an extension of the Ratification of the RPTKA by attaching some documents.

What things are there in the application for an extension of RPTKA ratification given by the employer of the foreign worker?

The Employer of the Foreign Workers shall make an application for an extension of the Ratification of the RPTKA by writing a statement regarding:

  1. identity of the Employer of Foreign Workers; What is meant by ""identity of the Employer of Foreign Workers"" includes the name, address, telephone number, sector/business field of the Employer of Foreign Workers.
  2. reasons for extending the Ratification of RPTKA;
  3. the position or position of the foreign worker in the organizational structure of the company;
  4. number of foreign workers;
  5. the period of use of foreign workers;
  6. work location of foreign workers;
  7. identity of the Foreign Worker Assistance; and
  8. realization of absorption of Indonesian workers

What documents must be attached by an employer when making Request for extension Ratification RPTKA?

A request for an extension of the Ratification of the RPTKA submitted by the Employer of Foreign Workers must attach at least the following documents:

  1. letter of application for extension of RPTKA;
  2. Ratification of the still valid RPTKA;
  3. work agreement or other agreement; What is meant by ""other agreements"" are among others a charter agreement, a letter of appointment from the head office, and a memorandum of understanding.
  4. a valid foreign worker passport;
  5. participation in social security programs;
  6. the identification number of the taxpayer of the foreign worker and the employer of the foreign worker; and
  7. report on the realization of the implementation of education and job training for Indonesian workers in accordance with the qualifications of positions occupied by foreign workers.

How long does it take the Minister or the appointed officer to issue the Ratification of the extended RPTKA?

In the event that the application for extension of the RPTKA Ratification is declared complete and correct, the Minister or the appointed official shall issue the Ratification of the extended RPTKA no later than 2 (two) working days.

How long is the period of time given in the ratification of the extended RPTKA?

The period of time for each ratification of an extended RPTKA is given for a maximum of 2 (two) years, especially in the case of ratification of an extended RPTKA in a Special Economic Zone, it is given a maximum of 5 (five) years.

Can the Employer of Foreign Workers apply for a change in the Ratification of the RPTKA?

Yes. Employers of foreign workers may submit an application for changes to the Ratification of RPTKA online to the Minister or appointed officer. The changes referred to are only regarding: the address of the TKA Employer, the identity of the Foreign Workers, the work location of the Foreign Workers, and/or the name of the Employed TKA Companion.
