Data Academy held a Gender Responsive Collective Bargaining Agreements (CBA) Workshop on June 25 - 27, 2021. There are 11 participants from PT. Coats Rejo Indonesia, PT. Gistex Indonesia SYN - Purwakarta, PT. Ricky Garment Exportindo, PT. Sepatu Bata Tbk, PT. CCH Indonesia and PT. EINS Trend in the workshop. The factories involved are factories that have been surveyed by Gajimu, with a nearly expired CBA.

Factory-level Trade Unions’ capacity building is a major need for preparing CBA renewal negotiation. As stated by the participants, The CBA needs to be immediately updated and adjusted given the need to respond to the new regulation, the Omnibus Law (No. 11 of 2020 concerning Job Creation). As we all know, after the emergence of the Omnibus Law, regulations related to Labour Law have experienced some regression.

In this workshop, participants are taught to use a method by making an inventory of problems in drafting regulations that are appropriate to be applied in their CBA. The discussions included the selection of priority issues, the obstacles to be faced when raising the issue as well as finding solutions and searching for additional data/information needed to strengthen the argument.

Participants were very enthusiastic practising using this method to find the best solution for the priority issues in their current CBA. Even though they were new, accompanied by facilitators provided by the Data Academy team, the participants succeeded in integrating evidence-based advocacy knowledge through their data with this method.

Some examples of the priority issues found and discussed in the workshop: 

  1. Protection of Women Workers Rights, there are issues such as the duration of maternity leave for women workers considered less and not enough in some cases, breastfeeding time and facilities that are not flexible and also difficult procedures for menstrual leave. As a result of the discussion, Participants proved their argument by using supporting data in the form of doctor's quotations regarding the postpartum period, recommended breastfeeding period and women's reproductive health. They also conducted a literature study comparing the duration of leave in other countries or other factories.
  2. Employment security and severance pay, responding to this issue participants calculate the appropriate working period for workers who have been contracted for years to be appointed as permanent workers. As an alternative, participants also included the employer's obligation to pay compensation according to the years of service for contract workers.

At the end of the workshop, participants acknowledged the benefits of the learning material that are delivered, especially the practice session using the List of Priority Issues. They believe that this method is useful to create a more structured CBA negotiation. Even after this workshop, the participants are still welcomed to consult and share experiences together through social media groups provided by the Data Academy team.
