Gender-responsive CBA Workshop Data Academy - what was learned in the CBA Workshop and how to join the CBA Workshop?

Collective Bargaining Agreement (CBA) is an opportunity for workers to achieve better rights than the applicable labor regulations. It has always been recognized the importance of CBA especially in the current situation, where the dynamics of national labor regulations are increasingly high. Therefore, increasing the capacity to formulate CBA’s is a major need at this time. Responding to this need, the Data Academy, which previously focused on data-based advocacy training, combines this advocacy knowledge with a strategy for preparing CBA using an instrument for mapping priority issues to be advocated in the CBA and the Problem Inventory List (DIM) outlining the problems faced, the forms of solutions, so that they can be identified. New regulations/articles in the CBA are formulated to address these problems. The following is information related to the CBA Workshop held by the Data Academy.

Who can take part in the Gender Responsive CBA Workshop?

Workshop participants are:

    1. Leaders of Trade Unions/Labor Unions at the factory level.
    2. Participants are the CBA negotiating team at the factory, prioritized for factories with nearly expired CBA.
    3. The factory where the participant works is a factory in the garment, textile and footwear sector that has conducted a work Decent Work Check survey or COVID-19 survey.
    4. Participants have good digital literacy.
    5. Priority will be given to female participants.
  1. Gender Sensitivity

Due to the fact that the target of this workshop is factories where the majority of the workers are female workers, it is important to include material related to gender sensitivity so that the resulting CBA regulates, among others:

  1. Protection from discriminatory practices
  2. Protection of reproductive health
  3. Occupational safety and health (K3) specifically for the protection of women workers.
  4. Prevention of sexual harassment and violence in the world of work.

 

  1. Reading and accessing employment information

In this session, participants learn to access data on employment, which will later be useful for building arguments when advocating for certain issues to be included in the CBA.

  1. Workshop – Determine priority issues and fill out the Problem Inventory List (DIM)

In the discussion session called the workshop, participants are introduced to the Problem Inventory List (DIM). This method is often used in drafting laws and regulations. On the priority topics to be discussed, the problems encountered, the form of solutions, regulations/articles that need to be drafted to overcome the problems, as well as data and existing regulations that support the new rules are described.

To determine priority topics, DIM is equipped with an instrument to map priority topics to be advocated with indicators of how often these cases occur, challenges when advocating for these issues, time required, etc. The purpose of this mapping is to make a list of topics that are priorities and have the opportunity to be advocated in the CBA.

Here, participants (in groups) present the issues they want to be advocated for and will get suggestions from other groups.

 

Who are the speakers in the CBA Workshop?

Speakers or what we usually call trainers are resource persons and facilitators, members of the Data Academy team who are experienced and have the capacity in the material presented. The Trade Union Rights Center (TURC), which already has credibility in conducting labor training, is one of the Data Academy partner organizations. We also invite presenters from other relevant organizations to fill in the material in our training such as Komnas Perempuan or the National/Regional Representatives of Trade Unions/Labor Unions. 

 

How many participants can take part in the CBA Workshop?

The maximum number of participants who can take part in the CBA Workshop is 20 people. One factory can send a maximum of 2 representatives.

 

How many times has the CBA Workshop been held in 1 year?

Data Academy holds CBA Workshops 2 times a year. However, the Data Academy team is open if a trade union/labor union or other organization requires the assistance of the Data Academy team to conduct similar training.
