Data Academy - Online Coaching Clinic, 3 July 2021
Data Academy’s Coaching Clinic is a follow-on activity after Collective Bargaining Agreement (CBA) Workshop, where Trade union partners discuss more thoroughly about the clauses in their CBA. Participants of CBA Workshop express the need to have follow-up discussion, it is one of the hopes for the participants to receive further training (coaching) after receiving the main CBA Workshop.
This year's coaching clinic was first held on July 3, 2021, together with alumni of the West Java CBA workshop participants from PT. Coats Rejo Indonesia, PT. Gistex Indonesia, PT. Ricky Garmen Exportindo, and PT Shoes Bata. Before the activity took place, participants had compiled a Problem Inventory List (DIM) for the application for renewal of the CBA in their company. The DIM method, which participants began to learn during the workshop, seemed to be increasingly used.
In this coaching clinic, gender has become the top priority discussion. The reason is mainly because trade unions often forget to advocate CBA with gender perspective and in particular protecting women's rights, although the majority of workers working in the garment and textile sector are women.
One of the discussions was related to additional articles/clauses regarding nursing room facilities in CBA. In several factories, a nursing room is already available in the company for women workers, however it has not been listed in the CBA. The Trade Unions believe that for legal assurance, clauses on nursing rooms need to be emphasized in the CBA. This includes providing supporting facilities including clean and adequate room size, with storage for breast milk, as well as providing time for women workers to leave their work to pump and/or breastfeed their children.
Another topic is the implementation of menstruation leave which is often hampered by burdensome procedures in the CBA, making it difficult for women workers to get their right to leave fairly. The procedure includes providing sick letters from outside company clinics. If not provided, women workers are not entitled for menstruation leave and/or her wages will be deducted if she insists. Trade union advocates a much simpler procedure. The addition of this article is accompanied by arguments and applicable government and international regulations.
During the coaching clinic, participants learned emphasizes making the argument stronger by adding data and legal base support. This data and legal information then are crucial for The Trade Unions when conducting negotiations with the management. Therefore, the new CBA submitted is better than the previous CBA.
